Terms of services

The Movement Dynamics Studio (TMDS)

Welcome to The Movement Dynamics Studio (“TMDS”, “we”, “us” or “our”). These Terms of Service apply to clients participating in personal training, strength and conditioning, fitness assessments, movement programmes and other services provided by TMDS.

By purchasing, booking or participating in a TMDS service, you acknowledge and agree to these Terms of Service.

Our services

TMDS provides personalised fitness and exercise coaching, including but not limited to:

  • Functional Strength Training

  • Muscle Building & Performance

  • Body Transformation

  • Corrective Exercise & Movement Restoration

  • Post-Rehabilitation Strength

  • Longevity Strength Coaching

  • Youth Performance

  • Mobility, stability and movement training

  • Fitness and movement assessments

Programs may be adjusted according to the client's goals, physical capabilities, training progress and other relevant considerations. TMDS provides fitness and exercise coaching and does not provide medical diagnosis, physiotherapy or medical treatment.

Health and medical responsibility

Clients are responsible for providing accurate and relevant information regarding their health, injuries, physical limitations, medical conditions and exercise history before beginning a program. Clients should seek appropriate medical advice or clearance before participating if they have an existing medical condition, recent injury, surgery or any other condition that may affect their ability to exercise safely. Clients must inform their trainer of any changes to their health, injuries, medication or physical condition that may affect training. TMDS reserves the right to modify, postpone or discontinue an exercise or training session where the trainer reasonably considers that continuing may not be appropriate or safe.

Post-Rehabilitation Training

TMDS post-rehabilitation and corrective exercise programmes are provided within the scope of fitness and personal training. They are intended to complement, rather than replace, treatment or advice provided by doctors, physiotherapists or other qualified healthcare professionals. Where appropriate, clients may be requested to obtain medical or physiotherapy clearance before commencing or resuming training.

Exercise Risk & Client Responsibility

Physical exercise and strength training involve inherent risks, including fatigue, muscle soreness, strains, sprains and other injuries. Clients are expected to follow their trainer's instructions, use equipment appropriately and communicate immediately if they experience pain, dizziness, unusual discomfort, shortness of breath or other concerning symptoms. Clients should not perform an exercise they believe they are unable to perform safely and should inform their trainer of any concerns. Nothing in these Terms excludes or restricts liability that cannot lawfully be excluded or restricted under Singapore law.

Training sessions

Clients should arrive on time and be appropriately prepared for their scheduled session. Sessions will generally begin and end at the scheduled time. Late arrival by a client may result in a shorter session so that subsequent appointments are not affected. The full session fee may still apply where a session is shortened because of a client's late arrival.

Appointment cancellation and rescheduling

Clients who need to cancel or reschedule a training session should provide at least 24 hours' notice. Sessions cancelled or rescheduled with less than 24 hours' notice may be considered used and deducted from the client's package. Failure to attend a scheduled session without notice may also result in the session being considered used. TMDS may make reasonable exceptions in exceptional circumstances at its discretion. If TMDS or the assigned trainer needs to cancel a session, the session will be rescheduled or returned to the client's available session balance.

Training packages

Training packages are intended for use by the client who purchased them and are not transferable to another person unless otherwise approved by TMDS. Packages must be used within the validity period communicated at the time of purchase. Unused sessions remaining after the package expiry date may expire unless an extension has been approved by TMDS. Package validity may be extended in exceptional circumstances, including certain medical situations, subject to reasonable supporting documentation and approval by TMDS.

Payments

Payment must be made according to the price and payment schedule communicated when purchasing a program or package. All applicable prices, taxes and charges will be communicated to clients before purchase. TMDS reserves the right to revise its prices, packages and programme offerings. Any price changes will not retrospectively change the price of a package already purchased unless otherwise agreed.

Refunds

Except where required by applicable law, payments made for commenced training programmes, completed sessions or expired sessions are generally non-refundable. Requests involving unused services will be considered according to the terms applicable to the package purchased and the circumstances of the request. Where a client is unable to continue training for medical reasons, TMDS may consider an extension, temporary suspension or another appropriate arrangement. Nothing in this section affects any rights a client may have under applicable Singapore law.

Trainers assignment

TMDS will make reasonable efforts to provide continuity of coaching. However, a particular trainer cannot be guaranteed for the entire duration of a programme or package. TMDS may assign or substitute another suitably qualified trainer where necessary due to scheduling, availability, leave, operational requirements or other circumstances. Training packages are purchased for services provided by TMDS unless expressly stated otherwise.

Results

TMDS is committed to providing structured, personalised and progressive coaching. However, individual results vary. Results may be influenced by factors including training consistency, nutrition, sleep, lifestyle, genetics, medical conditions, recovery and adherence to the programme. TMDS therefore does not guarantee any particular weight loss, muscle gain, body composition, performance, rehabilitation or other physical result within a specific period.

Youth training

Clients below the applicable age of legal capacity may be required to have consent from a parent or legal guardian before participating in TMDS programs. Parents or guardians are responsible for providing relevant health and medical information concerning the participant. Additional conditions may apply to Youth Performance programmes.

Personal belongings

Clients are responsible for their personal belongings while attending TMDS. TMDS will take reasonable care in operating its premises but is not responsible for loss or damage to personal property except to the extent that liability cannot lawfully be excluded.

Conduct & Safety

Clients are expected to behave respectfully toward trainers, staff and other clients. TMDS reserves the right to refuse or discontinue service where a client engages in abusive, threatening, dangerous, discriminatory or seriously inappropriate behaviour, or repeatedly disregards reasonable safety instructions.

Photography & Marketing

TMDS will obtain appropriate consent before using identifiable photographs or videos of clients for promotional, advertising or social media purposes. Clients may decline participation in promotional photography or videography without affecting their eligibility to receive training services.

Personal data & privacy

TMDS may collect and process personal information necessary to manage enquiries, bookings, payments, client records, program administration and communications. Personal data will be handled in accordance with applicable Singapore data protection requirements and the TMDS Privacy Policy. Where consent is required for marketing communications, clients may withdraw such consent through the methods provided by TMDS.

Changes of programs and services

TMDS may modify its operating hours, trainers, programmes, equipment, scheduling procedures and service arrangements where reasonably necessary. Where a material change affects an existing prepaid service, TMDS will endeavour to provide an appropriate alternative arrangement.

Website information

Information provided on the TMDS website, social media channels and other marketing materials is intended for general informational purposes. Fitness, health and exercise-related information should not be treated as personalised medical advice or as a substitute for consultation with an appropriately qualified healthcare professional.

Changes of these terms

TMDS may update these Terms of Service from time to time to reflect changes in its services, operations or applicable requirements. The latest version will be made available through the TMDS website. Changes will not retrospectively remove rights that a client has under applicable law.

Governing law

These Terms of Service are governed by the laws of the Republic of Singapore. Any dispute arising from or relating to these Terms or TMDS services will be subject to the applicable laws and jurisdiction of Singapore.

Cancellation policy

Kindly provide the minimum of 24 hours' notice for any changes (or) cancellations.

 

  • This policy ensure fairness to other clients who may be on the waitlist and were unable to secure a slot.

  • It allows adequate time to inform clients on the waitlist and gives them the opportunity to decide.

  • In the absence of sufficient notice, the session will be considered a no-show and charged as a session.
